I. Acceptance of Terms
Thank you for using Chowmeway Momoway. The purpose of these terms of service (the “Terms”) is to inform you of your legal rights and obligations with regard to your use of the MochowWay website at https://india.mochowway.com/ (the “Site”) and any affiliated mobile or software applications (the “MochowWay Platform”), including but not limited to the delivery of information via the website whether it is currently in existence or becomes so in the future that it links to the service T&Cs.
These terms apply to all current and prospective Chowmeway Momoway users, including users who have access to their claimed business listings on the “restaurant business page,” without limitation.
Please carefully read these terms. You are entering into a contract with MochowWay and/or its affiliates and accepting these Terms by accessing or using the MochowWay Platform. If you reject the Terms or are unable to abide by them, you are not permitted to use the Services. The MochowWay Platform is used at the user’s own risk, including the possibility of being exposed to disagreeable or otherwise improper content.
To use the services, you need to agree to the terms first. You can accept the terms by:
- Clicking on “accept/agree to the terms” where the T&Cs are made available to you by Chowmeway Momoway in the UI for any specific service; or
- Using the services. In this scenario, you agree and understand that Chowmeway Momoway treats your use of the services as a conscious acceptance of the Terms from that point onwards.
II. Eligibility to use the services
- You certify that you are fully able and competent to understand and agree to the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and that you are at least eighteen (18) years of age or older.
- Adherence to the law. When you access and use the Services, you abide by all applicable laws and regulations in the country in which you reside. You acknowledge that you may only use the Services in accordance with these Terms and any relevant laws, and that you must not act in a way that infringes upon our or anyone else’s legal rights.
III. Changes to the terms
Chowmeway Momoway may occasionally modify, amend, revise, or update these Terms at its sole discretion. You are in charge of periodically reviewing these Terms to make sure they are still being followed. Any time you use the MochowWay Platform following an amendment or change to the Terms, it will be assumed that you have expressly accepted the amended or changed Terms and that you agree to be bound by them.
IV. Service Provisions
- In order to give its customers the greatest experience and information possible, Chowmeway Momoway is continually changing. You acknowledge and agree that certain changes may be necessary to the form and nature of the services that Chowmeway Momoway offers. As a result, MochowWay reserves the right to suspend, cancel, or discontinue any or all products or services at any time without prior notice, as well as to modify and alter any or all of the site’s contents, products, and services without prior notice.
- We, the software, or the website where the software is offered for download may have a feature that checks for updates or upgrades to the software automatically. You agree that we or the appropriate software or software application store may notify you of the availability of such upgrades or updates and automatically push such upgrade or update to your device or computer from time to time, unless your device, its settings, or computer software does not permit transmission or use of upgrades or updates. In order to access or use the Services, or certain features thereof, you might need to install specific software updates or upgrades (including upgrades or updates designed to correct issues with the Services). The Services shall include any updates or upgrades that we deliver to you in accordance with the Terms.
- You understand and acknowledge that if Chowmeway Momoway bans access to your account, you might not be able to access the Services, your account information, or any files or other content that is stored there.
- The number of transmissions you can send or receive over the Services may not currently be subject to a fixed upper limit set by Chowmeway Momoway, but you acknowledge and agree that Chowmeway Momoway may at any time, in its sole discretion, impose such a fixed higher limit.
- We periodically conduct research and experiments on many areas of the Services and products, including our apps, websites, user experience, and marketing campaigns, in an effort to continuously improve the MochowWay Platform and Services. This means that at any given time, certain Customers may experience features differently than others. This is for improving customer experience, strengthening the safety and security of our services and offers, and developing new features and services for the MochowWay Platform.
- Chowmeway Momoway maintains the right to charge customers a subscription fee, membership fee, or any other price for any good or service on the MochowWay Platform at any time in the future.
- Chowmeway Momoway may occasionally roll out incentive-based referral programs for its customers (Program). These Program(s) may be subject to the terms and conditions that apply to them specifically. Customers agree to the terms and conditions of the Program as well as those governing the MochowWay Platform by taking part in the Program.
